Terms of Use
Hereinafter referred to as the "user," any internet user connecting to and using the site referred to as Premium Retail. The use of the Premium Retail site implies the complete and full acceptance of the general terms of use described below by users. These terms of use may be modified or supplemented at any time, so it is recommended for Premium Retail site users to consult them regularly. The Premium Retail site offers a range of services made available to users in their current state. It is expressly stated that users must maintain courteous behavior and act in good faith towards other Premium Retail site users. The Premium Retail site is subject to regular updates. Similarly, legal notices may be modified at any time. However, these modifications apply to the user, who is invited to consult them frequently to be aware of them.
1. Access to the Premium Retail Platform
The Premium Retail site is generally available to users 24 hours a day, 7 days a week, unless interrupted for scheduled maintenance or in exceptional circumstances. In the event of unavailability of the service, Premium Retail undertakes to make every effort to quickly restore access. Dates and times of intervention will be communicated to users wherever possible. Due to its commitment to the means implemented, Premium Retail cannot be held responsible for any damage, of any nature whatsoever, resulting from a service interruption.

The Premium Retail site aims to informatively present all the activities of the company Premium Retail SARL. We undertake to provide information as accurate as possible. However, we decline any responsibility for omissions, inaccuracies, or deficiencies in the updating of this information, whether due to us or to third-party partners providing this data. The information presented on the Premium Retail site is provided for informational purposes and may evolve. Furthermore, the information available on the Premium Retail site is not exhaustive and may have been modified since its initial publication.
3. Intellectual Property
Premium Retail SARL exclusively owns all intellectual property rights or has the rights to use all the elements accessible on the site, whether it be the structure, texts, images, graphics, logos, icons, sounds, software, and others... You hereby waive any moral rights in such information and/or content, to the extent permitted by law.
4. Limitations of Liability
Premium Retail SARL assumes the role of publisher of the Premium Retail website and is responsible for the quality and accuracy of the content it publishes. However, Premium Retail SARL cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the website. Such damages may result from the use of equipment that does not meet compliant specifications or the occurrence of a bug or incompatibility. Furthermore, Premium Retail SARL cannot be held liable for indirect damages, such as loss of market or loss of opportunity, resulting from the use of the site. Interactive spaces, including the contact space allowing users to ask questions, are provided. Premium Retail SARL reserves the right to remove any content posted in this space that violates applicable law in Morocco, including provisions relating to data protection, without prior notice. In the case of content that is racist, offensive, defamatory, or pornographic, in any medium used (text, photograph, etc.), Premium Retail SARL also reserves the right to hold the user civilly and/or criminally liable.

However, Premium Retail SARL cannot verify the entirety of the content of these external sites and declines any responsibility for potential risks associated with illicit content. 6. Management of Personal Data
1. Collection of Personal Data 1.1 Personal Data By browsing the Website, the User consents to the use of their personal data by the Company. This data includes, but is not limited to: - Names and surnames - Phone numbers - Postal address - Country of origin (where the ad was consulted from) - Email address - IP address (virtual of the computer) - Unique identifier and password 1.2 Nature of Data Collected The collected data is of various kinds and aims to improve the User's experience on the Site. 1.3 Data Processing Controller The responsibility for processing the User's personal data lies with: Premium Retail SARL 1.4 Processing Objectives The User acknowledges that the personal data provided by them and processed by the Company aims to enable it to manage commercial customer relations and prospecting, in compliance with CNDP declaration no. D-W-145/2018. These objectives include, in particular: • Generally analyze the traffic on the Website and its various sections; • Communicate to the User, via email, responses, various information, or ads posted on the Website by the Company or its Partners; • Send newsletters to the User by email, information on the evolution of the Website and its various sections; • Forward inquiries made by the User to selected third-party partners of the Company or to other third-party organizations for advertising purposes; • Send email alerts to customers interested in their offers.
2.1 Conditions for Exercising User Rights
To exercise their rights, the User can simply send an email to contact@premiumretail.ma providing proof of identity (mentioning their names, surnames, email address, and attaching a copy of their ID), in accordance with the provisions of Law No. 09-08 on the protection of personal data of natural persons.
2.2 Security, Archiving, and International Transfer of User Personal Data
The Company ensures the confidential collection and processing of the User's personal data, scrupulously respecting the provisions of Law No. 09-08 on the protection of personal data concerning natural persons. It undertakes to take all reasonable measures necessary to secure and protect the personal data of Users of its Website and Services, retained and processed by it. For optimal service and technical reasons, the User's personal data is stored on servers owned by the Company located in Germany. For computer security reasons, the User consents to the storage and transfer of their personal data to Germany, in accordance with the authorization granted by the CNDP under number: pending. All personal data of the User is subject to electronic archiving by the Company for the entire duration of their registration on the Website and is deleted once their registration is terminated.
2.3 Data Retention Period
Personal data is kept in a reasonable and proportionate manner to customer management and IT service objectives, with the following durations: • Customer management data: up to three (4) years from their collection; • Data provided through cookies: up to one (2) month from their collection; • Billing data: up to six (6) years from their collection.
7. Applicable Law and Jurisdiction
This Charter is governed by Moroccan law. Any dispute relating to its application, interpretation, validity, and execution shall be submitted to the Moroccan courts, failing amicable agreement between the parties.
